LOGISTICS, TRANSIT, AND FREIGHT FULFILLMENT AGREEMENT (SHIPPING POLICY)

PREAMBLE

This Logistics, Transit, and Freight Fulfillment Agreement (hereinafter referred to as the “Policy”) dictates the strict terms under which apka V (operating via https://www.apkav.in/) executes the physical distribution of its commercial apparatuses. By submitting an order and remitting payment, the purchasing party (hereinafter “End-User”) irrevocably assents to these logistical stipulations and entirely exculpates apka V from any statutory or equitable liability regarding third-party transit operations.

1. AUTHORIZED SHIPPING METHODS AND FINANCIAL TARIFFS

apka V utilizes a syndicated network of vetted third-party logistics (3PL) couriers to execute the delivery of the V mug kettle and associated commercial assets across India.

  • Carrier Discretion: apka V reserves the absolute, unilateral right to select the freight carrier or delivery network deemed most functionally appropriate for any given geographic trajectory. The End-User possesses no right to demand a specific courier entity.

  • Freight Tariffs: All applicable shipping, handling, and freight tariffs are dynamically calculated algorithmically at the point of checkout based on the End-User’s exact geographic coordinates and the volumetric weight of the shipment. These financial levies are the sole, unmitigated responsibility of the End-User. Any promotional waivers of shipping costs are executed at the absolute discretion of apka V and may be revoked at any time without prior notice.

2. ESTIMATED DELIVERY EPOCHS AND EXOGENOUS VARIABLES

While apka V strives for the expeditious dispatch of all procured merchandise, all delivery timeframes communicated on our digital portal are strictly estimates and are legally non-binding.

  • Standard Dispatch Window: Following the successful clearance and verification of the End-User’s payment instrument, order processing and physical dispatch to the courier typically occur within 24 to 48 business hours (excluding weekends and sanctioned public holidays).

  • Transit Estimations: Standard domestic transit times generally span from 3 to 7 business days, contingent entirely upon the geographic remoteness of the End-User’s designated delivery address from our primary distribution hub in Kannur, Kerala.

  • Absolute Exculpation for Delays: apka V explicitly disclaims and repudiates any and all liability for delivery delays. The company shall not be held liable for any direct, indirect, incidental, or consequential damages (including loss of time or profits) resulting from delayed freight. Delivery epochs are subject to immediate disruption by exogenous variables entirely beyond our operational control, including but not limited to: severe meteorological events, Acts of God, localized civil unrest, logistical strikes, third-party carrier infrastructure failures, or governmental mandates.

3. DISPATCH AND ORDER TRACKING PROTOCOLS

To ensure logistical transparency, apka V provides the End-User with the requisite digital telemetry to monitor their inbound freight.

  • Issuance of Tracking Data: Upon the formal handover of the physical parcel to the designated logistics partner, an automated electronic communication containing a specialized tracking cipher (AWB number) and the corresponding carrier’s digital tracking portal link will be transmitted to the End-User’s registered email address.

  • Tracking Instructions: The End-User assumes the sole responsibility for utilizing the provided tracking URL to monitor the real-time geographic progression of their parcel.

  • Third-Party Telemetry Disclaimer: apka V relies entirely on the API data feeds of external logistics partners for tracking updates. Consequently, we disclaim any responsibility for the accuracy, latency, or functionality of the carrier’s tracking infrastructure.

4. TITLE TRANSFER AND ASSUMPTION OF RISK (FOB SHIPPING POINT)

All physical commodities procured from apka V are executed pursuant to a shipment contract. Consequently, the legal title and the absolute risk of loss or damage for such items transfer entirely from apka V to the End-User at the exact temporal moment our personnel hand the parcel over to the first third-party carrier.

  • apka V accepts zero financial or legal liability for parcels that are stolen post-delivery, lost in transit by the courier, or structurally damaged during the freight journey. End-Users seeking remediation for transit-related anomalies must initiate a formal claim directly with the offending logistics carrier.

5. ADDRESS ACCURACY AND UNDELIVERABLE PARCELS

The End-User bears the unyielding burden of providing a hyper-accurate, comprehensive, and legally recognized shipping address, including a valid telephonic contact number, at the time of checkout.

  • Address Typographical Errors: apka V assumes zero liability for shipments dispatched to incorrect, archaic, or incomplete addresses supplied by the End-User.

  • Bounced Freight: In the event a parcel is classified as undeliverable and returned to our facility due to End-User negligence (e.g., failure to answer carrier phone calls, locked premises, or incorrect address data), the order will be subject to immediate cancellation. A refund will be issued to the End-User minus all original outbound shipping tariffs and a punitive return-to-sender logistical fee. Under no circumstances will apka V subsidize the cost of re-shipping a bounced parcel.
